bought XP on ebay and found it was OEM version

Bought XP Home edition on ebay and found out when I
received it that it was supposed to be installed with a
new computer. Am I allowed installing XP on my old pc
because I was unawares that it was to be distributed with
a new pc?

Perhaps. If that particular license has _never_ been installed on
any other PC, and if it is a generic OEM CD (not a proprietary CD
branded for a specific make/model computer), then you may have a
legitimate license. Ask the seller for the specific history and
antecedents of the CD and license.

If you are talking about a Retail OEM version yes it can be installed on any
computer.
These copies are sold to computer builders and if sold to the public they
are to be accompanied by a piece of hardware, usually sold after the
purchase of a Motherboard, Harddrive or major component, MS has relaxed
these requirements and will allow the sale as long as it is with a piece of
hardware of any kind.
Retail OEM versions are exactly Retail Upgrade & Full versions they all
contain the same files, the difference is that OEM versions are tied to the
computer system originally installed on and MS does not offer any support.

One more thing is that if the plastic wrap has been tore off the product
there is a chance that it has been installed on a different computer and you
should contact the seller, MS will not be able to help.
