No, if you used the upgrade version of XP pro then your license
for that is tied to the Home version you upgraded from.

Another point is that the version installed by Dell is an OEM
version and is only licensed for use on the computer it was sold
with. You cannot use it on any other computer even if you could
"convince" the Dell installation routine to install it.

You are not alone in your curiosity and/or disappointment with
the licensing terms.

The copy of Windows on the computer you purchased is permanently tied to the
computer on which is was first installed on. You cannot transfer this
license to another computer.

Aside from that, if you used XP Home as a prerequisite to fill the
requirement for the XP Pro Upgrade license, you no longer have an XP Home
license. The original OS license is absorbed by the upgrade license, and
can not be used as a stand-alone OS again.

Here is a licensing confusion to throw in.

For example some one has oem of win98se installed.
They install xp upgrade.
Xp upgrade ask if they want to keep 98se. They say yes.
Xp installs. Now they dual boot between 98se & xp.
98se license cant be absorbed by xp. Since your still using 98se.

I am Not accusing Microsoft of any wrong doing. Just a question.

But doesn’t this mean Microsoft is violating their own licensing
policy?

Unfortunately not. It was an 'OEM' license, solely for the machine it
came installed on.

And if (as I hope you did) you used an Upgrade version of Pro, that
needs the original system kept around in support of *that* license
anyway
